In light of the recent Supreme Court ruling we wanted to keep you up-to-date regarding the outcome of the Case. On Friday 15th January 2021, the Supreme Court issued its ruling, broadly supporting the appeals of the FCA and the Hiscox Action Group, and dismissing the appeals of the various insurers.
Please note that not every insurer or policy is included in the test case and the ABI has indicated that: “Customers who have made claims that are affected by the test case will be contacted by their insurer to discuss what the judgement means for their claim. All valid claims will be settled as soon as possible and in many cases the process of settling claims has begun.”
The findings are complex and will take a few days to digest and for each insurer to understand what is required, or not, of them. We are in dialogue with insurers, and Fenchurch Law, to interpret the ruling and understand the implications on various policies. Once we fully understand the position over the coming days, we will update you further.
